1. Who we are

This website, rowvane.com (the “Site”), is operated by Rowvane, 584 Glenferrie Road, Hawthorn, VIC 3122, Australia. “We”, “us” and “our” mean Rowvane. “You” means the person using the Site or placing an order.

2. Acceptance

By using the Site or placing an order you agree to these Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and our Product Disclaimer and Safety notice. If you do not agree, please do not use the Site.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

4. Products and descriptions

We describe our products as accurately as we can, including what they will and will not do and what other tools you need alongside them. Photographs and videos show the tools in use; the exact fastener, workpiece and conditions in your job will differ from ours.

Colours and finishes may vary slightly from the images on your screen.

Where we do not know something about a product, we say so rather than filling the gap.

5. Prices and currency

All prices are shown in US dollars and are exclusive of any import duties or taxes charged on delivery outside the United States.

We may change prices at any time. The price that applies to your order is the price shown at the moment you complete checkout.

We try hard to avoid pricing errors. If an obvious error occurs, we may cancel the order and refund you in full rather than fulfil it at the wrong price. We will tell you if this happens.

6. Orders

Your order is an offer to buy. We accept it when we dispatch the goods, not when payment is taken.

We may refuse or cancel an order — for example where the item is unavailable, where we suspect fraud, where a delivery address falls outside the countries we ship to, or where a pricing error has occurred. If we cancel after taking payment, we refund you in full.

7. Payment

Payment is taken at checkout through our payment providers. We do not store your full card details.

8. Delivery, title and risk

Delivery times, costs and import charges are set out in our Shipping Policy. Title and risk in the goods pass to you on delivery.

9. Guarantee and returns

Our 60-day money-back guarantee and our returns process are set out in the Return and Refund Policy, which forms part of these Terms.

10. Safe use of our products

Our products are hand tools that cut into hardened steel under load. Before using them, read our Product Disclaimer and Safety notice.

In short: wear eye protection, secure the workpiece, and do not exceed sensible torque. You are responsible for using the tools safely, for the equipment you drive them with, and for judging whether a component is fit for service after a fastener has been extracted.

11. Intellectual property

All content on the Site — text, photographs, video, graphics and the Rowvane name and logo — belongs to us or is used with permission. You may not copy, reproduce or use it commercially without our written consent.

Our products are sold through rowvane.com only. Listings elsewhere using our photographs are not ours, and we cannot honour our guarantee on them.

12. Acceptable use

You agree not to use the Site for any unlawful purpose, not to attempt to gain unauthorised access to it, not to interfere with its operation, and not to use it to transmit malicious code.

13. Third-party links

The Site may link to third-party websites, including carrier tracking services. We do not control them and are not responsible for their content, accuracy or privacy practices.

14. Disclaimers

The Site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free.

Fastener extraction depends on how badly the head is damaged, how deeply it is seized, what the fastener is made of, and how much access you have. We describe what our tools are designed to do and show them doing it, but we cannot guarantee that any particular fastener will come out. That is precisely why the 60-day guarantee exists.

15. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, for loss of profit, or for damage to vehicles, machinery, workpieces or property arising from use or misuse of our products.

Where we are liable, our total liability is limited to the amount you paid for the order concerned.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If you are a consumer, nothing in these Terms affects your statutory rights.

16. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or your misuse of our products.

17. Governing law

These Terms are governed by the laws of the State of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of the country in which you live, and you may bring proceedings in your local courts.

18. Changes

We may update these Terms. The version published on the Site at the time you place an order is the version that applies to that order.
